Warranty and Liability

Limited Warranty(Any actions performed under this line will void all warranty for CarWink)

  • Any damage or injuries caused by operating CarWink without following the proper steps listed in the instruction manual will void all warranty.
  • The Limited Warranty does not apply to normal wear and tear, does not apply when the Hardware is opened or repaired by someone not authorized by InnovArt Design and does not cover repair or replacement of any Hardware or part thereof damaged by: misuse, moisture, liquids, proximity or exposure to heat and accident, abuse, noncompliance with the instructions supplied with the Hardware, neglect or misapplication.
  • The Limited Warranty does not cover physical damage to the surface of the Hardware.
  • This Limited Warranty does not cover any software that may accompany or be installed on the Hardware.
  • The Limited Warranty does not cover the installation, removal or maintenance of the Hardware or any costs related herewith.
  • Please be aware that InnovArt Design DOES NOT condone any of the following actions that may result in the damage of the CarWink device: placement of CarWink in the microwave, an oven, a washing machine, a dryer, a dishwasher, a refrigerator, a bathtub, toilet, sink, cookwares, boiler, blender, mixer, etc.
  • CarWink is meant to be installed inside the vehicle (on the rear window). Any damages or theft caused by inaccurate installation will not be covered under the warranty.
  • If your vehicle is not a sedan, when opening the trunk, please pay attention to your CarWink device as it may suspend mid air, possibly falling.
  • If you have installed or are looking to install window tint on your vehicle, please be advised that InnovArt Design is not responsible for any potential damages to your window tint. For your own protection, we recommend purchasing a buffer product as a medium between the suction cup and window tint.
  • InnovArt Design is not responsible for any water or fire related damages relating to CarWink.
  • Accidental damages include but are not limited to:
    • Dropping of CarWink on a hard surface or in water.
    • Abandoning or placing the unit into fire or any flammable sources
    • Running over or physical destruction of the device
    • Intentionally throwing or forcefully applying hard objects against CarWink
  • If users do not disconnect CarWink from the USB charging source upon full charge.

Terms of Service:
Liability (Innovart Design Inc. will not be responsible for any injuries, accidents, death or any other unfortunate events caused by the below actions of the customer)

  • In case of theft or vandalism, InnovArt Design is not responsible for any loss, damages, repairs or compensation (both physical and monetary) relating to the incident.
  • To ensure usage safety and to avoid injury and property damage to you or others, please be sure to observe the following safety precautions. Failure to observe safety warnings may result in accidents when used incorrectly. Please read the instructions in the manual carefully before use. If an abnormality or malfunction occurs, stop using it immediately.
  • Neither InnovArt Design nor its suppliers shall be liable for you or for any third party for any indirect, incidental, consequential, special or exemplary damages (including in each case, but not limited to, damages for the inability to use the equipment or access data, loss of data, loss of business, loss of profits, business interruption or the like) arising out of the use of or inability to use the Hardware even if InnovArt Design has been advised of the possibility of such damages.
  • Notwithstanding any damages that you might incur for any reason whatsoever (including, without limitation, all damages referenced herein and all direct or general damages in contract or anything else), the entire liability of InnovArt Design and any of its suppliers shall be limited to the amount actually paid by you for the Hardware.
  • Notwithstanding the above, neither party’s liability for death or personal injury resulting from its own negligence shall be limited.
  • Some states and/or jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you.
  • Children, elderly or persons with disabilities and those without experience should use this product under supervision and direction of the person responsible for their safety.
  • Children should use this product under supervision to ensure that they do not use the product as a toy.
  • CarWink should not be considered as a non-toxic teething toy for toddlers.
  • CarWink comes with small parts that should not be consumed under ANY circumstances.
  • CarWink is not a toy and should not be given to any animals or pets.
  • InnovArt Design does not encourage the use of the touchscreen feature when the car is in motion. In the event of an accident caused by the driver’s distraction, InnovArt Design is not in responsible.
  • When misusing the CarWink device in any of the below methods, InnovArt Design will not be held liable for any injuries, or death:
    • Using a power source other than 110V AC, as this may result in a fire or electric shock.
    • When removing the plug, please hold down the plug before removing it. Do not pull the power cord hard and pay attention to whether the hand is dry. Otherwise, it may cause electric shock or injury.
    • Inserting pins, wires or other sharp objects into any gaps or openings in the CarWink device and get injured due to an electric shock.
    • Getting shocked due to the use of a different power source other than what is provided in the CarWink package and recommended in the manual.

本文中的項目將使CarWink失去有限保固服務之權利。

  • 未遵循說明書中的正確步驟操作CarWink，而造成的損壞或傷害，將會失去CarWink的有限保固服務之權利。
  • 有限保固服務不適用於正常的磨損、消耗。未經InnovArt Design授權的人員打開、拆解CarWink硬體時將失去有限保固服務之權利，並且不包括因以下原因造成的任何CarWink本體或零件的維修或更換：濫用、潮濕環境、液體接觸、接近或暴露於高溫環境和事故、濫用、不遵守InnovArt Design提供的說明，疏忽或任何不正確的使用。
  • 有限保固服務不包括CarWink表面的損傷。
  • 有限保固服務不涵蓋任何軟體與安裝於CarWink中的應用程式。
  • 有限保固服務不包括硬體的安裝、拆卸或維護或與此相關的任何衍伸費用。
  • 請注意，InnovArt Design不會容許任何可能導致CarWink損壞行為，例如：將CarWink放置在微波爐，烤箱，洗衣機，烘乾機，洗碗機，冰箱，浴缸，廁所，水槽，炊具，鍋爐，攪拌機，攪拌機等等。

服務條款：
